Terms and Conditions of Sale

1. Purpose
These Terms and Conditions of Sale govern access to and use of the Trackivo service, a SaaS application for competitive market monitoring designed for Airbnb short-term rental managers, operated by David Gharai (hereinafter referred to as "Trackivo").
2. Access to the Service
Access to the Trackivo service requires the creation of a user account and the subscription to a monthly plan. The service is accessible through the web application available at app.trackivo.fr.
3. Pricing and Billing
The Trackivo offer includes:
- Monthly subscription: €29.90/month, including 30 credits renewed every month
- Starter Pack: €9.90 — 30 additional credits (one-time purchase)
- Pro Pack: €29.90 — 100 additional credits (one-time purchase)
- Expert Pack: €74.90 — 300 additional credits (one-time purchase)
One credit corresponds to the analysis of one listing within a search. Credit packs are available only with an active subscription. Purchased credits do not expire.
All prices are stated in euros, including all applicable taxes.
4. Payment
Payments are processed exclusively by Lemon Squeezy (Lemon Squeezy LLC), a third-party payment service provider. Trackivo does not collect or store any banking information. Lemon Squeezy's payment terms apply. The subscription renews automatically every month on the anniversary date of the initial subscription.
5. Cancellation
Users may cancel their subscription at any time from their customer account, without fees or penalties. Access to the service remains active until the end of the current monthly billing period. Credits purchased through credit packs remain available after cancellation of the subscription.
6. Right of Withdrawal
In accordance with applicable regulations, users have a 14-day right of withdrawal from the date of subscription, unless the service has already been used. To exercise this right, please contact us at contact@trackivo.fr.
7. Limitation of Liability
Trackivo is a decision-support tool. Pricing and availability data originate from third-party sources (Airbnb) and are provided for informational purposes only. Trackivo does not guarantee the accuracy, completeness or permanent availability of the data. Trackivo shall not be held liable for business decisions made based on the information provided.
8. Service Availability
Trackivo undertakes to maintain service availability to the best of its ability. Temporary interruptions may occur for maintenance purposes or due to failures of third-party services (Apify, Supabase, Vercel). No automatic refund is provided for such interruptions.
9. Pricing Changes
Trackivo reserves the right to modify its pricing. Users will be informed by email at least 30 days before any pricing change takes effect. In the event of disagreement, users may cancel their subscription free of charge before the new pricing comes into force.
10. Governing Law and Disputes
These Terms and Conditions are governed by Spanish law. In the event of a dispute, an amicable solution will be sought as a priority. Failing that, the competent courts shall have jurisdiction. For any complaint, please contact: contact@trackivo.fr.
